This time the judge who gave the verdict in the raintree rape case lost his judicial power

News Desk: Judge of Dhaka Women and Child Abuse Suppression Tribunal-8 deleted the observation of not taking rape case after 72 hours. The Chief Justice took away the judicial power of Kamrunnahar.

On Sunday (November 14), Chief Justice Syed Mahmud Hossain curtailed his powers. Meanwhile, a letter has been issued to withdraw him from the court and attach him to the law ministry.

Earlier on Thursday (November 11), the court acquitted all the five accused in the rape case of two private university students at the Raintree Hotel in Banani.

The court said in its observation that the prosecution could not prove the allegations in the case. Unnecessary court time has been wasted. Besides, no sign of rape was found after 72 hours. He also ordered the police not to file a rape case 72 hours after the incident.

Judge deleted. After such observation of Kamrunnahar, riots started all over the country. Then Law Minister Anisul Haque said on Saturday that the observation that rape cases cannot be taken up after 72 hours is completely unconstitutional. A letter will be sent to the Chief Justice to take action against the judge.

Today, on Sunday, Chief Justice Syed Mahmud Hossain reduced the judicial power of that judge. Besides, a letter has been issued to withdraw him from the court and attach him to the law ministry.

Following the verdict, the judge said that the investigating officer was impressed and filed a chargesheet in the case. The medical reports of the victims did not contain any details of sexual violence. The DNA samples found in the victim's clothing did not match the defendants. After 36 days, they (the two students) said, "I am raped," and the matter should have been considered by the investigating officer.

By not doing so, the investigating officer wasted the court's 'public time', the judge observed.

The judge added as he read out the verdict, "You say - this is a case in point, but I don't think so. All cases are discussed and important to me. Nothing was found in the medical report of the case and the doctors could not provide any evidence.

The verdict was announced on October 12. But the verdict was postponed to October 28 due to the illness of the judge. But due to the death of senior lawyer Baset Majumder on that day, the court proceedings were adjourned and today was the day for pronouncement of the verdict.

The accused in the case are Safat Ahmed, Safat's two friends Naeem Ashraf alias HM Halim and Sadman Sakif, Safat's driver Billal Hossain and bodyguard Rahmat Ali. All the accused except Rahmat Ali have given confessional statements in the court under section 164 of the Criminal Procedure Code.

The two young women were brought to The Raintree Hotel in Banani on March 26, 2016 for a birthday party. It is alleged that the two young women were raped more than once after drinking alcohol.

The police did not file a case at first. Later, when the incident caused a commotion all over the country, on the evening of May 8 of that year, a female student, who had been accused of rape, filed a case with the Banani Police Station.

The five were accused in the case. Following the investigation, on June 8 of that year, Ismat Ara Amy, Inspector of Police, Women Support and Investigation Division, Dhaka Metropolitan Police, filed a chargesheet against the five accused. On July 13 of the same year, the court framed charges against five accused. After that the testimony started and it ended on 22nd August.
